ARTICLE I GENERAL
Summary:  This article provides an introduction to the structure and legal framework of the Land Development Standards for the Town of Waynesville, North Carolina.  This code combines the zoning and subdivision authority of the town into one document along with other land development regulations.  This section enumerates applicable statutory authority, the applicability of the Waynesville Land Development Standards to various uses and geographic areas of the town, and details the important consistency of this chapter with the town's Land Development Plan.

ARTICLE II DEFINITIONS AND RULES OF CONSTRUCTION
Summary:  This article provides an interpretive framework for the Land Development Standards for the Town of Waynesville, North Carolina. Included in this article are rules of construction concerning the town's official land development map and the text of this chapter.  Also included in this article is a listing of definitions of terms found within this chapter. 

ARTICLE III ADMINISTRATIVE AGENCIES
Summary:  This article describes the various agencies involved in the administration of the Town of Waynesville's Land Development Standards.  The jurisdiction, powers and duties of each agency or individual are described. 

ARTICLE IV
LAND DEVELOPMENT PROCEDURES AND AMENDMENT PROCEDURES
Summary:  Any development within the land development jurisdiction of the Town of Waynesville may require one or more permits or approvals in order to ensure that the development is consistent with the goals and purposes of this chapter and with the public health, safety and general welfare.  This article describes the various processes involved in the administration of the Town of Waynesville's Land Development Standards.   While the various procedures are set forth separately in this article, the town intends to accommodate, where possible, the simultaneous processing of applications for different permits and approvals which may be required for the same project, in order to make the review process as short as possible.   Agencies other than the Town of Waynesville may have separate procedures that must be followed in order to obtain approval for issues related to land development.  These agencies must be contacted to obtain information regarding the proper procedure for approval of plans or construction.

ARTICLE V
LAND DEVELOPMENT DISTRICTS

Summary:  This article divides the Town of Waynesville into districts for the purpose of regulating the use  of lands within and setting forth the development standards for each district.  A Table of Uses is provided.  In addition to the general land development districts set forth, overlay districts are also provided.

ARTICLE VI
SUPPLEMENTAL USE REGULATIONS

Summary:  This Article establishes criteria for particular uses that may be permitted within one or more of the land development districts established in Article V if meeting the requirements for the particular use set forth in this section.  The criteria for each use listed herein shall apply to uses permitted by-right subject to special requirements as well as to conditional uses which are also subject to conditional use review and standards as set forth in Sec. 154.083.

ARTICLE VII
GENERAL DEVELOPMENT, SITE AND PERFORMANCE STANDARDS

Summary:  This Article sets forth standards for land development in the Town of Waynesville's land use jurisdiction concerning a variety of different development issues. These standards are designed to ensure the compatibility of development within the Town of Waynesville and to implement the policies found in the town's land development plan. The applicability of the standards found in this article may vary based on use, location and land development district (as set forth in this chapter). The criteria set forth in this article, as with all other requirements, must be satisfied before an application for development will be approved.

ARTICLE VIII
ENVIRONMENTAL CONSERVATION STANDARDS

Summary:  This Article sets forth standards for environmental protection and conservation in the Town of Waynesville's land use jurisdiction concerning a variety of different environmental issues. The Town of Waynesville possesses an abundance of unique natural assets.  The standards set forth in this section address the enhancement and preservation of these important features. 

ARTICLE IX
SUBDIVISION STANDARDS

Summary:  This Article sets forth standards, in addition to those found elsewhere in this chapter, for the subdivision of land with in the jurisdiction of the Town of Waynesville.  These provisions are authorized by NCGS ? 160A-371 to 160A-376.

ARTICLE X
NONCONFORMITIES

Summary:  This Article serves to set forth provisions regarding the continued use of buildings, structures or property that was lawful at the time of the enactment of this chapter or any applicable amendment thereto, even though such use, structure or property does not conform with the provisions of this chapter.  This article also provides for the termination of nonconforming situations under certain circumstances.

ARTICLE XI
STANDARDS ENFORCEMENT

Summary:  This Article serves to set forth provisions regarding the procedures for enforcing the land development standards set forth elsewhere in this chapter.  This Article additionally sets forth the penalties for noncompliance with these standards and other mechanisms for achieving compliance.

ARTICLE XII
LEGAL STATUS

Summary:  This Article sets forth the provisions addressing the legal status on the following issues: separability; transitional provisions; and conflicts with other laws
